CITY OF HUGO PLANNING COMMISSION PUBLIC HEARING

The Planning Commission will hold a public hearing on Thursday, November 13, 2008 at 7:00 p.m. at Hugo City Hall to consider the following: Ordinance text amendments to sections of Chapter 90 of the Hugo City Code to update the Sign Ordinance. The sections that will be amended are Chapter 90, Section 90-1. DEFINITIONS and Chapter 90, Section 90-265. SIGNS.

The request of Frank and Jody Puleo, located at 6375 165th Street, for a site plan and variance to locate a temporary building on the property. The applicant is requesting a variance from the chapter 90, Section 90-272 COMMERCIAL AND INDUSTRIAL CONSTRUCTION STANDARDS for a proposed temporary building to be located on the property. The property is generally located east of Highway 61 and south of 165th Street and is legally described as that part of the SE 1/4, Section 8, lying S of N 956.6 feet, Washington County (full legal available at City Hall).

CITY OF HUGO ORDINANCE 2008-424 AN ORDINANCE AMENDING CHAPTER 90, ARTICLE IV, sECTION 90- 102 TO ALLOW NEIGHBORHOOD FOOD SERVICES AS A PERMITTED USE IN THE RESIDENTIAL SERVICE ZONING DISTRICT THE CITY OF HUGO ORDAINS:

Section 1. The City Council of the City of Hugo does hereby amend Chapter 90, Article IV, Section 90- 102, to state the following: (8) Neighborhood Food Services (refer to Sec. 1195-595.1)

Section 2. Severability. In the event that a court of competent jurisdiction adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not specifically included with that judgment.

Section 3. Effective Date. This amendment shall take effect upon its passage and publication.

CITY OF HUGO BOARD OF ZONING AND ADJUSTMENTS PUBLIC HEARING

The Board of Zoning and Adjustments will hold a public hearing on Thursday, November 13, 2008 at 6:30 p.m. at Hugo City Hall to consider the request of Daniel and Ranell Tennyson, located at 12582 Ingersoll Ave N, Hugo, MN for a variance from the shoreland setback requirements for the locations of new septic tanks. The shoreland ordinance requires septic tanks to be 75 feet from the ordinary high water mark of Sunset Lake; the applicant is proposing that the tanks be 30 feet from the ordinary high water mark. The property is generally located east of Sunset Lake and west of Ingersoll Ave N, and is legally described as Sunset Park Lot 29, Block 2, Washington County (full legal available at City Hall).

CITY OF HUGO ORDINANCE 2008-423 AN ORDINANCE AMENDING CHAPTER 90, Article VI, TO aDD Section 90-274 neighborhod fod services THE CITY OF HUGO ORDAINS:

Section 1. The City Council of the City of Hugo does hereby amend Chapter 90, Article V I, to add section 90-274 NEIGHBORHOOD FOOD SERVICES to state the following:

Sec. 90-274 Neighborhod Food Services such as traditional restaurants, cafes, carry-out, or delivery food services, except drive-through and drivein establishments are permitted, provided that:

Subd. 1 The hours of operation are from 6 am to 10 pm.

Subd. 2 The storage, preparation, and serving of food items are subject to the specific written sanitary requirements based upon the applicable State and County regulations.

Subd 3 Shipment or delivery of products shall be between the hours of 7 am and 6 pm.

Subd 4 If the business abuts a residentially zoned property, an odor filtration system may be required to reduce odor drift. Said system shall be approved by the building official.

Subd 5 Drive-in or drive-through services are prohibited, except with a conditional use permit.

Subd 6 Outdoor entertainment or speakers that play music are prohibited.

Section 2. Severability. In the event that a court of competent jurisdiction adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not specifically included with that judgment.

Section 3. Effective Date. This amendment shall take effect upon its passage and publication.
