Liquor Compliance Penalties Imposed

The Lino Lakes City Council met as the Liquor Control Board prior to its regularlyscheduled October 27 meeting to consider imposing penalties on Jason’s Bobby & Steve’s Auto World in Lino Lakes for violating the terms of its liquor license during a compliance check on August 29, 2008.

Bobby & Steve’s co-owner Jason Snyder commended the city for the professional manner in which it conducts its compliance checks, and noted that he takes the violation “very seriously.”

“We are all about compliance, whether it showed on August 29 or not,” Snyder told board members. “It’s an eyeopener.”

According to testimony presented at the hearing, an underage clerk made the sale of a sixpack of 3.2 beer to an underage buyer. At the recommendation of Lino Lakes Police Captain Kent Strege, the Board recommended that a penalty consistent with the city’s Best Practices Grid be imposed.

When asked by Board Member Jeff Reinert why penalties are higher for Off-Sale 3.2 Malt Liquor licenses, Captain Strege stated that statistical data demonstrates that Off-Sale Licenses provide for a “larger chance” of sale to under-age buyers.

All other establishments passed the compliance check.

Liquor license holders were notified by letter on July 31 that checks would take place in August.

In its regular meeting, the City Council:

• During open mike, heard a request from resident and member of the Citizens for Safer Roads Committee Pat Smith that the city conduct an audit of the way the Lino Lakes Charter Commission conducts its business. The council took the request under advisement.

• Heard a request from resident James Lansberger during open mike that the bridge on Main Street over I-35W be replaced due to its age, increasing traffic pressure on Anoka County 23, and the possibility of obtaining federal funding to complete the bike path link.

• Authorized the certification to Anoka County of delinquent water and sewer utility charges for collection with the 2008 property taxes payable in 2009. Just short of 200 properties made the list.

• Adopted Resolution No. 08-124, fining Jason’s Bobby & Steve’s Auto World $1,000.00 for failing a liquor compliance check held this summer.

• Adopted Resolution No. 08- 129 clarifying the term “chiropractor” as used within the city’s Zoning Ordinance includes the treatment animal patients as well as human patients.

• Authorized city staff to request the Metropolitan Council for a time extension until May 29, 2009 to complete the mandatory local government unit review of the city’s draft Comprehensive Plan. The request was to be made by Nov. 1.

• Approved final payment for the Lino Park grading and trail project to Jay Brothers, Inc. in the amount of $4,207.04, which includes two change orders for a final contract amount of $67,791.19. The one-year warranty period begins.

• Adopted utility assessments for the property located at 510 Birch Street following a recent request for connection to city water.
