Council Orders Removal Of Structure

At its July 14 meeting, the Lino Lakes City Council reached the end of its patience and ordered the demolition of the home located at 745 Oak Lane, first declaring it a hazardous structure under the provisions of state statute. City Building Official Peter Kluegel told council members that the home in imminent danger of collapse, with a collapsed roof, structurally deficient and moldy walls, a cracked foundation, and multiple broken windows, and poses an attractive nuisance to children.

The owners have 30 days from the time they are notified of the council’s action to remove the structure, or the city will do it and assess the costs against the property.

According to Kluegel, the owner of the home is deceased and the building has been held up in probate for three years.

City Attorney Scott Baumgartner said that if the city can get written consent from family members to remove the building, it could be razed within the month and will prevent extra expense on the part of the city.

In other action, the council:

• Decided not to waive its monetary limits on tort liability limits. Under state law, an individual claimant would be able to recover no more than $400,000 on any claim to which the statutory limits apply.

• Authorized staff to issue a six-month peddler’s license to both Patrick Miller Construction of Blaine and Direct Exteriors, Inc. of Maple Grove for door-to-door sales of roofing, siding and gutters.

• Approved a special event permit and cabaret license for Miller’s On Main Outdoor Dance Event, scheduled for August 15 and 16 in conjunction with Blue Heron Days. The Lino Lakes Police Department will be monitoring sound levels during the event.

• Approved the acquisition of a permanent drainage easement for the Judicial Ditch 10-22-32 culvert extension beneath Lake Drive, in the amount of $9,957.00.

• Accepted plans and authorized bids be taken for the 2008 Surface Water Management maintenance project.
