Council Moves To Adopt Right-of-Way Ordinance
At its meeting of June 23, the Lino Lakes City Council voted 4-0 (Council Member Dan Stoltz was absent) to approve the second reading of Ordinance No. 09-08, Administration and Regulation of Public Right-of-Way.
According to a staff memo prepared for the City Council, this ordinance "brings all companies under one uniform set of standards, streamlines the franchising process, and removes questions about the extent of the city's authority over non-franchised utilities such as the telephone companies."
The ordinance implements a "degradation fee," which will be charged at the city's discretion to recover costs associated with a decrease in the useful life of the right-of-way caused by the excavation.
In addition, the ordinance requires any person who obstructs or excavates the public right-of-way within the city's borders, including county roads or state highways, to first obtain a permit from the city. A specific exception is made for persons planting or maintaining boulevard plantings or gardens within the public right-of-way.
In other action, the council:
. Approved Resolution No. 08-66, approving renewal of the city's 11 tobacco licenses for the 2008/2009 licensing period.
. Approved an application from the Lino Lakes Lions Club for renewal of a premises permit to allow charitable gambling at American Legion Post #566 to continue. The permit must be approved by the state Gambling Control Board.
. Deferred discussion on an item concerning tort liability to its work session of July 7.
. Voted 4-0 to approve the second reading of Ordinance No. 10-08, which will establish a six-month moratorium on the issuance of off-sale liquor licenses to permit the city to conduct a study of the city's regulations concerning the issuance of such licenses. The ordinance will become effective on July 30, 2008.
